Who Qualifies for Consular Processing?
To qualify for consular processing, family members must meet the following criteria:
- Be a spouse, parent, or child (under 21) of a U.S. citizen
- Have never been unlawfully present in the U.S.
- Have no (or very minor) criminal histories in their home country
Additionally, the U.S. citizen petitioner must not have any criminal history involving sex crimes. While these stipulations are generally required, there may be exceptions.
